I'm going to make a game that's gonna be about a dream that Guybrush has, so is it possible to make an avi of a tiny certain part from monkey island 3 and use it as an intro without getting any trouble about copyright violation or whatever?
Ofcourse it goes without saying that I'm gonna put Lucasarts in the credits, since it's kind of a spinoff thingy I guess.
We can't say for certain that you won't get into trouble, but if you keep the game underground, and of course, free, you probably will get away with it scott-free. (you'll be fine)
many games have used liscensed art and sound from companies, including materials from lucasarts, but most of them go by them without them even knowing.

Yes, it's a copyright violation since you're using the distinctive character of Guybrush Threepwood (as well as their graphics).
Also, you're probably going to get away with it, but bear in mind that it's technically illegal, and that LucasArts has closed down fangames in the past.
Thanks, I guess I'll just leave that out then, just to be safe. Atleast it'll be a challenge to get around that and still use the idea. It's going to be my "warm-up/training game" before I make my longer( and hopefully full length) AGS game I already started with.

I wouldn't worry about it either way, really. Just bear in mind that gamers are far more critical of a fan game than they are about something original.
The important thing to keep in mind is this:
LucasArts owns the copyright until about the year 2100 (that's way off but I don't really care). Anyway, the important bit is this (not the other part): LA hasn't shut down a fan-game since FOMI (Fate Of Monkey Island for all you infidels) part...5 I think. And that's been years now.
As long as you don't sell the game for profit and if LA tells you to stop production you obey orders, then they most likely won't do anything.
On a slightly related note, why is it that fans have no legal rights, yet those wishing to crack a joke are protected (fan-based materials including copyrighted material are illegal, parodies including copyrighted materials are not)?

What about Lucasfan and his Maniac Mansion remake and Zak McKracken sequel? He was shut down less than a year ago.
You won't get in trouble (at least not at first), you'll just get a letter from a lawyer telling you to stop production. What are the chances of that? Roll the dice ....

I believe there is legislation to protect direct parody and satire, at least in the UK. I think this is a good thing, because it's important that people are able to make fun of things.

it will be a free AGS game so there won't be much stopping of production.

It's more or less not based on Guybrush though, so it's kinda less of a fan game than the standard fan game.

Well, the web site says "Recent events have forced us to shut down our web appearance." I thought this was around the time other fan games were shut down. If he wasn't shut down, I guess I made a false assumption. My apologies. :(
They took down their site to stay out of the eye, after the Kings Quest shutdown -- which then turned into a company-backed fansequel.
But I understand that they don't want attention until much more progress has been made, or as far as to not mention anything until release day.

That's a matter of free speech. You are allowed to criticize things, and parody is a valid form of criticism. As a matter of democracy you should be allowed to make politicians look like fools in newspaper cartoons. Jack Chick and Jack Thompson don't like it much but there you go.
