Title: Copyright Image Questions

The technical section said this was not appropriate there, so ...

Does any know the copyright issues for images of people in a freeware game?  If the game is free can you use someone's image without their permission?

I'm pretty sure you can, because it doesn't deprive the author of any profit.

The only thing you can't do is pass it off as your own work -- that also violates copyright too, so you must include a not that regard the original author of the image.

I don't know about the law, but I'd sure be pissed off if someone used my art without getting my permission first.. I mean, how hard is it to ask? I suppose it's different if the artist doesn't give you any way to contact him/her, and it also depends on how you use the art (as a forum avatar vs. the title screen of your game).. But generally it's a good idea to get permission. I'm sure most people wouldn't say no, as long as you gave them credit..

Aye that's true -- I figured, since it was freeware, you wouldn't need to seek permission and just give the author credit.

But seeking permission is the polite thing to do, so do what Ben said.

Whether or not it's freeware is irrelevant.

As long as a copyright exists for the images (sounds, songs, etc.), they are the intellectual property of someone. You must obtain their permission to use the works.

At least under U.S. law...

What I am doing is using the QFG4 dialogue box which can use images of people talking.  It is the image of individuals I am talking about.  If I use a vidcap from an old movie (altering it to fit the game), does the vidcap violate the copyright of the movie (even if it is altered)?

The copyright of any material lies with the creator, full stop. Freeware or not, unless otherwise specified, you are not allowed to use other people's work. This copyright is automatic unless otherwise agreed (ie. you work for a company that autopmatically owns the copyright to everything you make).

To be safe contact the original creator and ask for permission.
