Legality question for a new game I want to begin

Hello everyone.  I'm a newbie to posting here.  I've been tinkering with AGS for a few months, and finally got the hang of scripting fairly well.  Anyways, I am an enormous fan of the old Quest for Glory series, and am less than thrilled at the two fangames I've seen (QFG 4 1/2 and Quest for Orgy), so I wanted to make my own. 

Would I have any problems with taking the classic QFG music and background images from the original games?  I will be pretty heavily modifying the images to reflect my setting of 30 years later, but I didn't know if this was a no-no or anything like that.  I don't want to step on any toes with whomever owns those rights to the images/music.

BTW: If anyone is curious, the storyline is immense, and centers on the son of the hero from the original series of games.

For personal use, it would be fine. If you plan on distributing the game say, on this site - may be a little more dodgy - and to sell it, well, that'd just be silly, you'd get sued.

I'd probably distribute it to whomever wanted to check it out, but I wouldn't even dream of trying to make any money off it.

While distributing it as freeware online probably won't get enough attention to get you in legal troubles, there are ethical questions to think about. In my opinion, as long as you clearly state the original authors and artists, you're not committing very much of a sin. I should stress, though, that, in my opinion at least, copyright is more than a legal question. It's also a matter of respect for the rights of a creating artist. But as I said, in cases like this it's not too bad.
