Just change the names and no one will care. IP for a video game is actually really hard to protect which is why they threaten with cease and desists. If you steal physical assets like sprites and whatnot that is protected by copyright and you can get in trouble and be sued by a company with a hell of a lot more money than you (yay!).

Don't make a remake, that is pretty much protected. Don't use their assets and try not to use their character names. The rest is pretty much free game.

It's possible. First a)I couldn't manage to contact the right proprietor for a much smaller game (that means they completely disregard you) b)You'll probably receive a template letter simply stating you can't. c) You wouldn't be able to buy one copyright out of them. It's like wanting to buy Sephiroth.

Look at me, BBC doesn't give a f#$%. And that's for the best.
H2G2? That's more Douglas Adams' estate. And maybe Activision (if they hold any ancillary rights still related to the original Infocom game).

On this topic... H2G2 and the Indiana Jones games like FOY do violate rigths?
In the case of FOY the sprites are different, and the backgrounds too, but they are still using the brand "Indiana Jones".

yep, they are both illegal uses of intellectual property but fortunately either they don't care or they don't know about them.

Icey, I say keep making PMQ2, and you'll probably get away with using some FF character names and ideas as long as you keep it low key... at least while you're in the process of making the game.  Then, once the game is made and released, they can't really tell you to stop, and there'll be enough copies of the game online for people to play it.

But I must say PMQ3 is sounding good.  Keep it up dude, I admire your energy.

Ah.  Couldn't resist.

Mostly meant as a joke, but something like that would solve all of your copyright problems.

And of course you may consider pengaboes and moobles to be securely within the public domain.

I spy as-yet unused plot elements for an Oceanspirit Dennis game...

Humm....my OSD takes place in the world of PMQ(senpah) so I could use them in pmq and OSD

What are the copyright rules involving parody and fair use? They make fun of final fantasy on Robot Chicken, so if your game is a parody you might be able to get away with using the characters and stuff as long as you don't rip any sprites. if your game is serious though it might be harder to claim fair use.

On a related note didn't Quest For Glory 4.5 contain ripped sprites and backgrounds from the game? How did they get away with it and not receive a cease and desist?

Calin Leafshade

there are several grounds for fair use, which exempt them from copyright.

they include:-

Comment & criticism
Parody
Archival or illustrative purposes

beyond that you are probably breaking the law.

... 40% of 100 ...
Hahahahahaha :P Sorry, but I find it absolutely hillarious that you  point out that 100 is the maximum.

But that's good news that you decided to remove copyrighted stuff. Good luck with your project :)
