Is it abandonware?
That depends on the definition you're using, but regardless of whether you call something "abandonware" or not, it remains copyrighted for approx 95 years after the death of the author (no, I'm not kidding) and it would be illegal to download it until then.

Esseb

Even using the most popular definition of abandware, it isn't abandonware. Lucasarts are still selling it.

Indeed. Multiple copies are in HMV, along with the last of the LucasArts adventures.

The copyright on the back states "(c) LucasArts 2007" so these are current print runs of those games, not old stock.

Really? I thought it was 70.

Copyright is authors life + 50 years + 20 years (mickey mouse protection act) and for corporate authorship 75 + 20 = 95. But Monkey Island is most probably trademark of LucasArts so it will remain protected as long as trademark is used (although this could be more or less than authors life + 95 years :))

As I recall, when some of Disney's copyrights were about to expire they started a lengthy lobbying campaign to extend the period. This was eventually succesful. It will likely be increased again within the decade.
